ball joints

my friend and I replaced all 4 uppers and lowers. Problem is we had to get rid of the sway bar links. on the way to the shop the sway bar rammed into the upper ball joint,I believe it seperated the boot from the joint now i can see the post under the boot, this is right right? I wonder if I could get the auto store to believe it was defective?

Its a damaged boot, buy one. They are cheap enough.
