Don't mean to sound like a jerk but really your buddy should of checked/had everything checked out by a professional before purchasing the car. Just cause someone says all that stuff is there doesn't mean it's really there unless you check it out. Sucks that he got scammed but that's what happens now a days. I really don't think there is anything he can do about it or would be able to get his money back.

I know what your saying. I been down this road personally before but i just took it as a lesson learned. He seems to want to push the issue so I just wanted to see how my fellow gbody members felt he could or couldnt do

it really comes down to $. court costs are HIGH!

if you are all about your principles and feel like this guy was such a snake that you absolutely need revenge, court is a great way to get back if your case is looking 'sure thing' status. However, you wont make much money out of this ordeal unless you're in Texas where court fee goes to the loser - court will cost you a lot $$$ especially if you live far from your county seat and have to drive there 3-5 times!

This really puts you in a tough decision and the next move I'd make if I was you is to call this seller in the presence of your legal counsel as a recorded phone call and see if this person incriminates themself when you take a mild accusatory tone with him on the phone! If he doesn't come off like a snake on the phone - chances are he may not have known the engine was lame and bought it that way

Regarding the letter "written and signed" by the seller, did your friend sign this letter as well :?: If he did, then he signed that he verified the items in the letter and has no ground to stand on.

How does somebody come about owning a "back halfed" third gen Camaro and not know enough to identify a rear end or look for the "RHS" on the heads :roll:

I mean, it sucks that he was taken advantage of ... but people have to know to get help when looking at a car in this category :| I hope he can recover some money from the deal.

Has he comfronted the seller about the misrepresentation :?:

as long as he has the ad, the only thing he can do is a civil suit. and the judge may still say that he bought the car as is, and it was up to him to do the research etc. cause now the guy can say, threat he sold him the car with all the stuff in it and your friend swapped it out etc. it is a very hard cause to prove and the burden is usually on the buyer and not the seller, unless you can prove actual fraud of some sort, which is this cause, not so much.

has he contacted the seller and expressed all of this to him, if so, what was the response?

He traded his 79 malibu for the camaro he didnt even know it was a 9in until i looked at it he just knew the car had in his word big *ss tires. Camaro ran until it dropped a valve. He never signed the paper. As far the heads all he knew was there alluminum so the guy must be telling the truth.

Its a tough call :|
He should really confront the seller in person (take a witness) and try to resolve the problem outside of the court system. I just think its going to be hard to prove that the car didn't have the parts in it at the time of sale :idea:

not much you can do either get seller to come clean or not other than that chalk it up as a loss i was somewhat beat in the same manner and police say not much to do besides civil suit and at the end of the day youll just be out more money. after missing work, travel, counsel ect : (

Just talked to my buddy. He just got off the phone with the guy supposably tomorrow he is going to bring his camaro to my house and take just the motor and will come back for the car when he has the $$$ my buddy pit out on deal. I personally dont think he will come back for car but we will see. I will let everyone know if he shows.
