A bad TPS sensor.

Check the reference voltage going into the TPS, it should be about 5 volts.

Yes its 5 volts, i forgot to mention when i swapped in the 5.0 engine on this car i kept the old v6 sending unit on the gas tank the new fuel pump on the v8 has an extra return line that i capped off could that be causing the problem?

No, it would not affect thd TPS, it is most likely bad. Through you might have gas tank venting issues with the line capped off. The factory fuel pump for a 5.0 should be 3 lines, same as the V6.
