It my fault even though she was speeding and hit me because the police said with no witnesses they can't determine how fast she was going. The speed limit was 10 and her air bags deployed and spun me a round so I'm going to try and fight it maybe.

i was turning left from a stop sign and the speed limit is 10mph so i saw her and she was far enough away i could have gone but she was going faster then 10mph probably 25 to 35 mph and didnt even slow down she said she was doing 15 but i dont think so she hit me so hard my outside cover thing for my dash flew off. but anyways she didnt slow down and hit me i almost did a 180 but i hit the curb and stopped me. its my word against her word since there wasnt a witness but my insurance agent says if she hit you hard enough for you to spin around and her air bags to be deployed she was going faster then 15. i feel if she was going 15 she could have slowed down to avoid the collision. we will see what happens. how hard is it to put a new quarter panel? or whats other options
oh and the quarter panel is seperating from the the rest of the car and there is a huge crease in the middle of the quarter panel now.
sorry about your wreck, hopefully a little physics can prove that she was in the wrong... gotta say though, your statement, "how hard is it to put a new quarter panel? or whats other options" after a bs wreck, those are words of a true car guy! Best of luck with court and the repairs!
Ya I hope so but I don't know what has to be done or how to prove that she was going to fast. Anybody have any suggestions on how to do this? And thanks ya I just want it to be fixed but I'm thinking I should wait til this is all taken care of and after I get a bunch of quotes and what not.
Doesn't matter how fast she was going. You pulled out in front of her right? You failed to yield the right of way. I know its bullshit but in my experience thats how it works out. Honestly though, 10mph speed limit and she was doing 25mph maybe??? Not really a big speed difference when it comes to seeing how close she is. SUCKS, believe me. I have been hit before and it sucks. I hope it works out to where you can get stuff replaced. Small claims court may be the way to go if you can prove she was going whatever speed. The accident report should have what the policeman thought she was doing as far as speed. You called the police right?
Ya I know it sucks an my insurance agent said that there is a 50 50 fault thing in Washington. I know I'm at fault because I pulled out in front of her the cop said it was my fault and ya we called the cops and he basically said with no witnesses it's my word against hers mine and there's a big difference from driving ten and 25 maybe not at higher speeds but 10 mph is crawling
Why could they not hit a door or front fender?? Something that can be unbolted and replaced..
