Got into an accident

Ya that's what I'm saying if she would have hit the door I could have just swapped it out and they got the door resprayed so it matched. Oh well though I guess I'm just going to learn some things. I'm going to try and do it myself being a college student I don't really have the money to get it done by someone. I have a few options right now. Either I buy a whole el camino for like 500-600 and use it for parts or I buy a skin for it for 299 or the whole thing with the pillar that goes over the window. Do you think I should just get the skin or what's the best option?
 
There's a good possibility that it can be straightened out, but it might not look 100%. I suppose a good body (metal) man could whip that back in shape.
Being that the rest of the car is clean and straight, a quarter skin might be the way to go. Just carefully explore your options.

I'm just trying to help so I hope it does not come across as prickish, but you are at fault. Was a liability investigator for 5 years before I finished up my ME degree so I do have some training and experience. You are fighting a losing battle uphill.

Was this in a parking lot or something? 10mph is a pretty slow speed limit.

Here's the deal...
neg #1) She had the right of way. (BIG)
neg #2) You had the greater duty of care in making a turn.
neg #3) damage location (if it was in the very back of the vehicle, may have more of a point) Also, I know it's only one picture, but the damage does not look too bad considering how you were hit.
neg #4) no witnesses
neg #5) you admitted to seeing her. The law says you have to be sure coast is clear before turning. Conversely, if you had admitted you did not see her you would be equally screwed...

pos #1) She may have been speeding, however it's hard to prove how much. Might want to get pics of her car if they support your case.
pos #2) Posted speed is 10 mph, suggesting that authorities know it is a bad intersection (that's how I would fight it)

At these speeds, the differences between 10 and 25 mph imo are not enough to put her more than 50% at fault. If she was doing 60mph, then probably.

Also, I've seen airbags going off when I would have thought it was impossible. They are designed to go off on full frontal impact with a stationary object (barrier) at just under 15 mph. However, I have seen them going off hitting stuff in the road with the undercarriage and pretty minor damage. Airbag systems measure deceleration, so if it senses one part of the car decelerating differently than other parts, it deploys. A vehicle decelerating, accelerating, spinning, etc can screw with the numbers.

If there was any obstructions to your view, it could be to your advantage.

Were you or was she cited? Put at fault on the accident report? How's your driving record and age? These could be to your advantage.

To argue it, I would try to argue the speed limit being necessary in the first place and other pro's you might have.

It was in a parking lot and I could only see the top of her car not the whole thing due to tall grass and forests and neither of us were cited due to it being private property and she hit me right behind the door with her 2300 pound Saturn sl and spun my el camino which is between 4400 to 4900 so she hit me with some force and ya I know I am at fault but I feel as if it's both out faults due to her speed but we will only see. I have picture of both our cars and she hit my car then continued to roll another 10 to 15 feet oh and it's downhill to I went back there later and in order to 10 to 15 mph you have to hit the brakes and she wasn't doing that due to her not even touching her brakes when I saw we she was 7 to 10 car lengths away and I make that turn everyday and turn when cars are that far away everyday after school. I have one prior accodent two years ago. And thanks for the info.
 
Man, that's a shame, hope you can get it fixed. Based on what I've seen over the years, I think you're probably hosed as far as fault, but it's worth trying; it may work out for you.

Well first thing is at least your alright . also i would go back and take pics of your vantage point .You said there is tall grass and stuff obstructing your view . might help in your case .
 
25 mph is 2.5 times 10 mph! That a difference between 14.6 ft/sec and 36.6 ft/sec. May not seem like much, because there is a big diffence when trying to stop a vehicle.... I suggest getting a couple of buds with a video camera or two and make a few videos from your vantage point and from hers, at 10 mph and at 25/30mph...just to show the difference between the two speeds and the stopping rate for each situation. Video is great proof of reinactment of a crash when there were no witnesses. I feel, although technically its your fault because you pulled out into her path, if she was speeding, she may have caused the accident, because if she hadnt been, she could have slowed or stopped in time to avoid hitting you in the first place. Thats why there are speed limits in the first place.

I had a similar situation about 15 yrs ago in Florida. I was following a lady in a van through my neighborhood. She turned left towards a side street with out a blinker on. So I kept going forward after she turned...but then she turned back right into my path and up into her driveway! I stopped as fast as I could to avoid hitting her, but she kept going and the side of her van ripped the front of my car off and she drove up into her driveway! Cops said I was at fault for failure to yeild and following too closely. I contested it, took a few pictures of the area, my car, her van, drew up a schematic of the streets, and took her to court. Judge said it was her fault, for not indicating direction and for changing lanes without looking first. So.... It can be done. Good Luck!
