Well the monte was hit by a drunk driver lastnight. I had a few beers and did some playing around with the carb and wanted to take it for a spin. I went to turn around on the side of the road when it stalled out. I had my flashers on and was blocking about half the road. I saw a car coming and got out to wave him by. I realized he wasn't slowing down so I dove in the ditch. That's when I heard him slam into the side of my car. He ended up in a field and was life flighted out from there. I was taken in and got a DWI but not cited for the accident. The other guy is alive and well I was told and is at fault. He was blackout drunk.

DAMNIT!!!! hope you are counting this for the ones that WERE definetly looking out for you there brennan!!! glad you were not injured in this and hope, the leSSon was/is learned...

so sorry to hear , that just bites , fight that DWI charge tooth and nail.
your / any insurance company will not pay a cent if your convicted on it.
if convicted , then it's a whole new world of pain with insurance rates in the future .

What's the best way to go about fighting it? I wasn't in the vehicle and my actions didn't cause the accident. I did admit to driving though.

Honestly I didn't feel drunk at all. I know that sounds cliche but it was just me and a few friends tuning on it drinking beer like normal. I have done it a hundred times. Go down the road and back. I didn't get cited for the wreck I just hope he doesn't try to come after me for medical sh*t.

Not knowing the laws in your state , in ontario it would be care and control .we have 100 ways to charge an impaired driver.
No I am not saying you were impaired ,
did arresting officer have you blow into a Breathalyzer ? walk a straight line ? impound your car ? lock you up till they considered you sober ?

My advice to you is get a lawyer !!! talk to a few about your case first before hiring one......yes they are being interviewed for this position.
if convicted the end results will follow you for life , something as simple as crossing the border into Canada , and maybe other countries too.

A good friend of mine is looking at insurance of $12,000 plus a year for that least the next 2 years due to an impaired conviction, and he cannot travel to the US without getting a pardon first ( no idea what that will cost )

Please treat this charge seriously , if convicted the other driver could have a solid case to sue you .

Is there a lawyer in the house ?
