I think you'll want an attorney for that. How is your car insured? Standard auto policy or historical, do you have a stated value? Plan on keeping it?
 
Just good reason and an example to stay away from alcohol. Period.

I haven't followed everything that was done to that car but it was a really clean and straight black car. Assuming it could be fixed, but the value isn't there for these cars and the legal headaches are a killer.
 
I have basic liability insurance with historical plates.


Court is Monday morning as in 2 days from now. I don't think I have time to get a lawyer and I basically admitted to drinking before I left when I was in the police station. They kept me for an hour or so to do paper work then released me.


I did the basic sobriety tests at the scene but didn't do the breathalyzer til got to the station. I blew a .15 I believe.


The man who hit me has a history of drinking issues and he was trashed when he hit me.


Since it was less than a mile from my house the car was towed straight to my house. Do I really have to worry about him coming after me even though he was drunk and could have easily avoided me? I know I screwed up but my car was on the side of the road with the flashers on and me and my buddy were directing cars past us with flashlights. No one else had a problem seeing me. He didn't even slow down, hit the horn, or turn.

not but it would be an aggravating factor with your charge of DWI if you were at fault

What do u mean "a caution"? From all I know I'm not at fault for anything besides the DWI. I wasn't cited for anything but that.
 
also how long after your last beer did they give you a breathalyzer and did they do two tests
 
Well the monte was hit by a drunk driver lastnight. I had a few beers and did some playing around with the carb and wanted to take it for a spin. I went to turn around on the side of the road when it stalled out. I had my flashers on and was blocking about half the road. I saw a car coming and got out to wave him by. I realized he wasn't slowing down so I dove in the ditch. That's when I heard him slam into the side of my car. He ended up in a field and was life flighted out from there. I was taken in and got a DWI but not cited for the accident. The other guy is alive and well I was told and is at fault. He was blackout drunk.

court monday morning?, get any lawyer ( you find a lawyer on a sunday )to ask for it be remanned to a later date

that's almost double the limit in Ontario....what is the limit in Ohio ?

here you state the car was on the side of the road..... in court keep your story straight , the D.A. will pick you apart on the stand

in closing get a good lawyer , and be careful of what you post on online it could be used against in a court of law ...criminally or civil.

It does not matter if your car was blocking half the road if it was visible a safe distance down the road. It would matter if you willing parked it there and if it was around a bend making it hard to see until you are too close to stop or make an evasive action.
