ok now I now where I should be looking what tells the converter to lock up and when, is it rpm road speed eng vaccum ? and how do we diag this problem

Does it shift into second ok with no odd noises? It could be the 2-4 apply band, but that would mean you would have lost second as well.

shifts great into all gears just no 4th or od or converter not locking up trans works ok to that point then acts just like a 3spd trans, which is leading me as to what makes it go into overdrive

4th is overdrive, the last "shift" you usually feel is the torque conv locking in...

If it shifts into 1st, 2nd, and 3rd and you don't feel ANYTHING after that, it's not going into overdrive which means the torque converter isnt locking up with the engine. Needs to shift Three times essentially. 1-2, 2-3, and 3-4(OD).
